Terms of Service

1.1 Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Pylot ("Company," "we," "us," or "our") governing your access to and use of the Pylot platform, including our website, applications, and all related services (collectively, the "Service").

By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1.2 Eligibility

To use the Service, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• If using the Service on behalf of an organization, have the authority to bind that organization to these Terms

1.3 Electronic Agreement

You agree that by clicking "Sign Up," "Get Started," or similar buttons, or by using the Service, you are entering into a legally binding contract. This electronic acceptance has the same legal effect as a physical signature.

2.1 Account Creation

To access most features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Not create accounts using false identities or on behalf of others without authorization
• Not create multiple accounts for the purpose of abusing promotions or circumventing restrictions

2.2 Authentication Methods

You may register and sign in using email/password or through third-party OAuth providers including:

• Google
• Meta (Facebook/Instagram)
• LinkedIn
• X (Twitter)
• Bluesky

By using third-party authentication, you authorize us to access certain information from those services as described in our Privacy Policy.

2.3 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Immediately notifying us at support@getpylot.com of any unauthorized access or security breach

We recommend using strong, unique passwords and enabling any additional security features we offer. We will never ask for your password via email or phone.

2.4 Business Accounts

Pylot uses a multi-tenant architecture where each user account is associated with a business profile. If you create a business on Pylot, you represent that you have the authority to act on behalf of that business.

3.1 Platform Overview

Pylot is an AI-powered social media management platform that enables businesses to:

• Generate social media content using artificial intelligence
• Schedule and publish posts across multiple social media platforms
• Analyze and develop brand voice profiles
• Track engagement metrics and analytics
• Manage media assets including images and videos
• Plan and execute content campaigns

3.2 Supported Platforms

The Service currently supports publishing to and/or integration with the following social media platforms:

• Facebook (Pages and profiles)
• Instagram (Feed posts, Reels, Stories)
• LinkedIn (Personal profiles and company pages)
• X (Twitter)
• Bluesky
• TikTok

Platform availability may change as third-party APIs evolve. We do not guarantee continuous availability of any specific platform integration.

3.3 Key Features

• AI Content Generation: Create platform-optimized posts using artificial intelligence
• Brand Voice Analysis: Analyze your existing content or website to develop your brand voice
• Multi-Platform Publishing: Post to multiple social networks simultaneously
• Smart Scheduling: Schedule content with timezone-aware delivery

4.1 Nature of AI Content

Pylot uses artificial intelligence, including services provided by OpenAI, to generate social media content, captions, and suggestions. You acknowledge and agree that:

• AI-generated content is created by machine learning models and may contain errors, inaccuracies, or inappropriate content
• AI outputs are suggestions only and require human review before publication
• The quality and appropriateness of AI content depends on the inputs and context provided
• AI technology is continuously evolving and outputs may vary over time

4.2 Your Responsibilities

When using AI-generated content, you are solely responsible for:

• Reviewing all AI-generated content before publication
• Ensuring content accuracy, appropriateness, and compliance with applicable laws
• Verifying that content does not infringe on third-party intellectual property rights
• Making any necessary edits or modifications before publishing
• All content published through the Service, regardless of its origin

4.3 AI Image Generation

Pylot offers AI image generation through Replicate. When using this feature:

• Generated images are subject to content safety filters
• You may not attempt to generate prohibited content including but not limited to: illegal content, content depicting minors inappropriately, hate speech, or content infringing on others' rights
• Some generated images may be blocked by safety filters; this is normal operation
• You retain rights to use generated images for your business purposes

4.4 No Guarantees

We make no guarantees regarding:

• The accuracy, completeness, or reliability of AI-generated content
• The performance or engagement of AI-generated content
• The suitability of AI content for any particular purpose
• Compliance of AI content with platform-specific policies

5.1 Ownership of Your Content

You retain all ownership rights to the content you create, upload, or import to the Service ("User Content"), including but not limited to:

• Text, captions, and written content
• Images and photographs
• Videos and multimedia content
• Brand assets and logos
• Business information and profiles

5.2 License Grant to Pylot

By using the Service, you grant Pylot a worldwide, non-exclusive, royalty-free license to:

• Store, process, and transmit your content as necessary to provide the Service
• Format and adapt your content for publishing to various social media platforms
• Display your content within the Pylot interface
• Analyze your content to generate brand voice profiles and content suggestions
• Create derivative works such as thumbnails and previews

This license exists solely for the purpose of operating and improving the Service and terminates when you delete your content or account, except for content already published to third-party platforms.

5.3 Content Analysis

To provide brand voice analysis and content optimization, we may:

• Import and analyze your existing social media posts from connected platforms
• Crawl publicly accessible pages of your business website using Firecrawl to extract brand information
• Process your content through AI systems to identify tone, style, and communication patterns
• Store analysis results to improve content generation for your account

5.4 AI Training Disclosure

We use OpenAI's API services for content generation. Per our agreement with OpenAI, content submitted through their API is not used to train their models. However, your content may be used to improve Pylot's own recommendation systems and service quality for your account.

5.5 Content Representations

You represent and warrant that:

• You own or have the necessary rights to all content you upload or publish
• Your content does not infringe on any third party's intellectual property or other rights
• Your content complies with all applicable laws and regulations
• You have obtained all necessary consents from individuals depicted in your content

6.1 Prohibited Activities

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Post, publish, or distribute illegal, harmful, threatening, abusive, defamatory, or obscene content
• Engage in spam, including mass unsolicited messaging or automated posting abuse
• Impersonate any person or entity, or falsely claim affiliation with any person or entity
• Distribute malware, viruses, or any other harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers connected to the Service
• Scrape, data mine, or extract data from the Service except as expressly permitted
• Use the Service for any purpose that competes with Pylot
• Circumvent any rate limits, access controls, or security measures

6.2 Platform Policy Compliance

When publishing content through Pylot, you must comply with the terms of service and community guidelines of each destination platform, including but not limited to:

• Meta Platform Terms and Community Standards (Facebook, Instagram)
• LinkedIn User Agreement and Professional Community Policies
• X (Twitter) Terms of Service and Rules
• Bluesky Terms of Service and Community Guidelines
• TikTok Terms of Service and Community Guidelines

Violations of platform policies may result in removal of content, suspension of platform access, or termination of your Pylot account.

6.3 Rate Limits and Fair Use

To ensure service quality for all users and comply with third-party API limitations:

• We may impose limits on the number of posts, API calls, or other actions
• Different subscription tiers may have different usage limits
• Excessive use that degrades service for others may result in temporary restrictions
• Platform-specific limits apply (e.g., TikTok: max 6 posts/minute, 15 posts/day)

6.4 Enforcement

We reserve the right to:

• Investigate suspected violations of these Terms
• Remove or disable access to content that violates these Terms
• Suspend or terminate accounts that violate these Terms
• Report illegal activities to appropriate authorities
• Cooperate with law enforcement investigations

7.1 Social Platform Integrations

To provide publishing and analytics features, Pylot integrates with third-party social media platforms through their official APIs. When you connect a social media account, you:

• Authorize Pylot to access your account according to the permissions requested
• Grant us permission to post content, read analytics, and perform other authorized actions
• Acknowledge that your use of connected platforms remains subject to their terms of service
• Understand that platform availability depends on third-party API access

7.2 Third-Party Service Providers

We use the following third-party services to operate Pylot:

• OpenAI: AI content generation and natural language processing
• Replicate: AI image generation
• Firecrawl: Website content extraction for brand analysis
• Stripe: Payment processing and subscription management
• Amplitude: Product analytics and usage tracking
• Vercel: Hosting and media asset storage
• Neon: Database hosting

Each third-party service has its own terms of service and privacy policy. By using Pylot, you acknowledge that certain data may be processed by these services as necessary to provide the Service.

7.3 Data Sharing with Third Parties

We share data with third parties only as necessary to provide the Service:

• Content and prompts sent to AI providers for generation
• Payment information sent to Stripe for billing
• Usage data sent to analytics providers in anonymized form
• Content sent to social platforms for publishing

7.4 No Endorsement

Pylot's integration with third-party services does not constitute an endorsement of those services. We are not responsible for the availability, content, or practices of third-party services.

8.1 Data We Collect

To provide the Service, we collect and process:

• Account Information: Email, name, password (hashed), profile information
• Business Profiles: Business name, industry, website, locations, preferences
• Social Media Credentials: OAuth tokens for connected platforms (encrypted)
• Content: Posts, captions, images, videos, and media you create or upload
• Analytics Data: Engagement metrics from connected social platforms
• Usage Data: How you interact with the Service, features used, actions taken

8.2 How We Use Data

We use collected data to:

• Provide, maintain, and improve the Service
• Generate AI content tailored to your brand voice
• Process payments and manage subscriptions
• Send service-related communications
• Analyze usage patterns to improve the product
• Detect and prevent fraud, abuse, and security issues

8.3 Data Security

We implement industry-standard security measures including:

• Encryption of sensitive data including social media credentials
• Secure HTTPS connections for all data transmission
• Regular security assessments and updates
• Access controls and authentication requirements

8.4 Privacy Policy

9.1 Subscription Plans

Pylot offers various subscription tiers with different features and limits. Current plans and pricing are available on our website. We reserve the right to modify plans and pricing with reasonable notice.

9.2 Free Trial

We may offer a free trial period for paid plans. Unless you cancel before the trial ends:

• Your trial will automatically convert to a paid subscription
• You will be charged the applicable subscription fee
• Trial terms (duration, features) may vary and are specified at sign-up
• Trial offers are limited to one per user/business

9.3 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you:

• Authorize us to charge your payment method for subscription fees
• Represent that you are authorized to use the payment method
• Agree to keep your payment information current
• Acknowledge that Stripe's terms of service apply to payment processing

9.4 Automatic Renewal

Paid subscriptions renew automatically at the end of each billing period (monthly or annually) unless cancelled. You will be charged the then-current subscription rate at each renewal.

9.5 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:

• You retain access until the end of your current billing period
• No refunds are provided for partial billing periods
• Your account will revert to the free tier (if available) or be suspended

9.6 Refunds

We generally do not provide refunds for subscription fees. However, we may consider refund requests on a case-by-case basis for:

• Significant service outages or failures on our part
• Accidental duplicate charges
• Other circumstances at our sole discretion

9.7 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will apply at your next renewal period. If you do not agree to a price change, you may cancel before the new price takes effect.

10.1 Service Availability

We strive to maintain high availability of the Service. However, you acknowledge that:

• The Service is provided "as is" without guaranteed uptime
• We may perform scheduled maintenance with reasonable notice when possible
• Unscheduled downtime may occur due to technical issues or security concerns
• We do not guarantee any specific service level agreement (SLA)

10.2 Third-Party Dependencies

The Service depends on third-party platforms and APIs. We are not responsible for:

• Outages or changes to social media platform APIs
• Platform policy changes that affect our integration capabilities
• Rate limits or restrictions imposed by third-party services
• Content moderation actions taken by social media platforms

10.3 Media Limitations

Media uploads are subject to format and size restrictions that vary by platform:

• Images: Generally up to 30MB, common formats (JPEG, PNG, GIF)
• Videos: Size limits vary by platform (e.g., TikTok up to 500MB, Instagram Reels up to 100MB)
• Duration: Video length limits vary by platform and post type
• Format: MP4 and MOV are generally supported; other formats may require conversion

10.4 Feature Modifications

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

11.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

11.2 AI Content Disclaimer

We specifically disclaim any warranty or guarantee regarding:

• The accuracy, appropriateness, or effectiveness of AI-generated content
• The performance or engagement of content created with our AI tools
• Compliance of AI content with any platform policies or legal requirements
• The availability or consistency of AI generation features

11.3 Third-Party Platform Disclaimer

We are not responsible for:

• Actions taken by social media platforms against your accounts or content
• Changes to platform APIs, policies, or terms of service
• Loss of access to connected platforms or published content
• Errors or delays in content publishing due to platform issues

11.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• PYLOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• THIS INCLUDES BUT IS NOT LIMITED TO: LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
• THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE)

11.5 Jurisdictional Variations

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12.1 Your Indemnification Obligations

You agree to indemnify, defend, and hold harmless Pylot and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

• Your use of the Service
• Your User Content, including any claims of infringement
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights
• Your violation of social media platform terms or policies
• Any dispute between you and any third party

12.2 Indemnification Procedure

We will:

• Provide you with prompt written notice of any claim
• Allow you to control the defense and settlement of the claim (subject to our approval for settlements that would adversely affect us)
• Provide reasonable assistance in the defense at your expense

13.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in your settings

Upon termination, you remain responsible for any outstanding charges and your license to use the Service terminates immediately.

13.2 Termination by Pylot

We may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, including but not limited to:

• Violation of these Terms or our Acceptable Use Policy
• Violation of social media platform policies
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• Extended period of inactivity
• Request by law enforcement or government agency
• Discontinuation or material modification of the Service

13.3 Effect of Termination

Upon termination:

• Your right to access and use the Service immediately ceases
• Any licenses granted to you under these Terms terminate
• You remain liable for all fees incurred prior to termination
• Provisions that by their nature should survive termination will survive (including disclaimers, limitation of liability, indemnification, and dispute resolution)

13.4 Data Retention After Termination

Following account termination:

• We may retain your data for a reasonable period for legal, regulatory, or legitimate business purposes
• Content already published to third-party platforms remains on those platforms subject to their policies
• You may request deletion of your personal data in accordance with our Privacy Policy
• Anonymized or aggregated data may be retained indefinitely

14.1 Governing Law

These Terms and any dispute arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Kentucky. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

14.3 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

14.4 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Pylot regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

14.5 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by Pylot to be effective.

14.6 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. These Terms are binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

14.7 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• For material changes, we will notify you via email or prominent notice in the Service
• Your continued use of the Service after changes take effect constitutes acceptance
